Download T&C as PDFExpert and goal-oriented consulting is one of our core competencies, which we generally provide free of charge. However, if fulfilling a customer’s request requires an above-average amount of consulting effort, we are happy to offer this service at the fair price of CHF 80.00 per hour. Upon the customer’s request, an initial cost ceiling for the consulting can be specified.
In this case, Appenzeller & Benisowitsch drei-de will immediately notify the customer when this ceiling is reached. From this quote onwards, until a contrary written agreement is made, all consulting services are subject to a fee. Appenzeller & Benisowitsch drei-de will commence providing the consulting service once the customer has accepted and confirmed the quote in writing.
The client requests a quote from Appenzeller & Benisowitsch drei-de for the production of a 3D print and submits the data via the internet. Appenzeller & Benisowitsch drei-de reviews the data and may issue a quote. Quotes based on erroneous, incomplete, inaccurate or not yet available documents are only non-binding indicative prices.
Appenzeller & Benisowitsch drei-de carries out the order based on the documents provided by the customer. Due to missing or incomplete information, the price may still vary after the quote has been issued. If needed, the 3D print is produced by a verified partner from the ecosystem. This allows drei-de to offer you all technologies, materials and suitable post-processing – at a low price.
As mentioned under the heading “Printing”, drei-de commits to the manufacture of the ordered 3D print. In particular, 3D printing and 3D scanning can and will be produced or carried out by one of our verified partners from the ecosystem. Drei-de always remains the contracting party and is the customer’s point of contact at all times. There is no direct contact between the partner and the customer. Data protection is guaranteed at all times and secured by NDAs.
Appenzeller & Benisowitsch drei-de commits to producing the ordered printed product in 3D format. The client provides the electronic data necessary for printing and pays the contract price as well as all additional costs incurred in connection with the production. This expressly includes the costs for processing the client’s data.
The contract is concluded when Appenzeller & Benisowitsch drei-de confirms the client’s acceptance of the quote by e-mail. Any subsequent amendments or changes to the contract are also only valid in writing; e-mail is sufficient.
Unless otherwise agreed, the quoted or confirmed prices are net prices including value-added tax, transport and insurance costs. For large orders that can no longer be handled via standard postal service, an alternative shipping method will be defined in consultation with the customer and charged to the customer.
Unless otherwise agreed, payment is due within 10 days without deduction from the date of delivery of the work.
After expiry of this payment term, the customer is in default of payment of the contract price and statutory default interest begins to accrue; the customer will also be notified of this with the first reminder. This reminder is sent by e-mail.
The first reminder is free of charge. The second reminder is issued 10 days after the first reminder and incurs a fee of CHF 20.00.
Delivery of the work takes place within 30 days or as agreed, after the conclusion of the contract; shorter delivery deadlines must be confirmed in writing (e-mail is sufficient) by Appenzeller & Benisowitsch drei-de to be valid.
Exceeding the delivery date or non-compliance with the delivery deadline for which Appenzeller & Benisowitsch drei-de is not at fault (e.g. operational disruptions caused by work stoppages or strikes, power shortages, shortage of raw materials and cases of force majeure) do not entitle the client to withdraw from the contract or to hold Appenzeller & Benisowitsch drei-de liable for any damage incurred. In cases of other deadline overruns, Appenzeller & Benisowitsch drei-de is liable up to a maximum of the value of the goods.
Copyright on creative and design services is governed by the applicable statutory provisions. In principle, the client is responsible for ensuring that the printed product complies with copyright regulations. Appenzeller & Benisowitsch drei-de only checks whether copyrights are infringed by the print within the scope of its minimum legal obligations.
Any property rights to data and copyrights of the client remain protected. However, the client has no claim to the retention or surrender of the provided data, unless this is expressly agreed in the print contract. Data that has been designed by Appenzeller & Benisowitsch drei-de on behalf of the customer only becomes the property of the client once the contract price has been paid.
The reproduction and printing of all templates, samples and the like provided by the client to Appenzeller & Benisowitsch drei-de is carried out on the assumption and condition that the client holds the corresponding reproduction rights.
Industry-standard deviations in execution and material are reserved. Insofar as tolerances are imposed on Appenzeller & Benisowitsch drei-de by suppliers, these also apply to the client. Unless otherwise defined or agreed, tolerances are in the range of +/- 0.1 mm. However, Appenzeller & Benisowitsch drei-de cannot guarantee these tolerances, as tolerances in additive manufacturing are always dependent on various parameters.
The works contain various chemicals necessary for their production and durability. Depending on the material, they are neither particularly heat-resistant nor impact-resistant; they may be damaged by contact with liquids or release toxic substances. The works are therefore generally only suitable as models, design samples, decorations and prototypes, but not for practical use – unless their suitability has been explicitly assured by us.
Our products may contain small parts. These are not suitable for small children. There is a risk of choking if small parts are swallowed or inhaled.
The statutory warranty period of two years applies from the moment the goods are transferred to the customer.
Works delivered by Appenzeller & Benisowitsch drei-de must be inspected upon receipt. Any complaints regarding quality (in particular tolerances, surface quality and stability) and quantity must be made immediately; otherwise the delivery is deemed accepted. In the case of justified complaints, rectification will be carried out within a reasonable period. Reduction and rescission are excluded. For hidden defects, the statutory provisions of Art. 371 OR (Swiss Code of Obligations) apply.
The risk in the work passes to the buyer from the date of readiness for dispatch. A different agreement remains reserved. If delivery is delayed through no fault of Appenzeller & Benisowitsch drei-de, the goods will be stored at the expense and sole risk of the buyer.
Appenzeller & Benisowitsch drei-de accepts no responsibility whatsoever for data submitted by the client that is incorrect or incomplete in terms of content. Liability is also rejected if delivered data cannot be processed or used in a standard manner and this results in qualitative defects in the printed product. No liability is assumed for loss of delivered data that is to be further processed.
Appenzeller & Benisowitsch drei-de expressly excludes all liability in the event of improper use of the works. Liability is limited to gross negligence. Any liability beyond the material value for any further claimed direct or indirect damages arising from defects is excluded.
The place of performance for both parties is the registered office of Appenzeller & Benisowitsch drei-de. The ordinary courts at the respective registered office of Appenzeller & Benisowitsch drei-de are therefore also competent to adjudicate disputes. However, Appenzeller & Benisowitsch drei-de reserves the right to take legal action against the client at the client’s registered office or domicile. Swiss law applies.
By confirming the order, the client confirms having read these General Terms and Conditions and agrees to them.

An exception to this principle only applies if you have given your consent, the processing is necessary for the performance of a contract between you and us, or we are obliged to disclose the data (for example due to a legal obligation, such as disclosure to law enforcement authorities).
